Nicole E. Durkin
Nicole E. Durkin's mulitfaceted practice encompasses a broad range of commerical and civil litigation matters, particularly in relation to the construction industry on both a federal and state level through appeal, including relevant commercial transactions and complex dispute resolution as necessary. Practicing law for the past sixteen years, she has acquired experience in broad practice areas and has a proven track record of exceptional advocacy on behalf of her corporate and individual clients. She possesses the judgment skills and ability to see through complex issues and roadblocks to find and implement reasonable solutions in order to effectively protect her client in often complicated and sensitive business transactions. She represents clients in a range of pre-suit disputes through all stages of litigation.
In particular regard to her construction industry clients, including developers, contractors, construction companies, suppliers and home owners, she provides comprehensive representation on all matters from commerical and residential construction defect and design litigation, building code violations and the filing and foreclosure of liens to contract, bond and payment disputes. If a contractor is faced with a licensing issue, she represents them in responding to, and appearing before, various administrative boards and committees.
Ms. Durkin also has extensive experience representing clients in all types of real estate land use/zoning matters including applications for, and objections to, commercial site plan approvals, variance requests, special exception requests, certificates of appropriateness, code violations and easement disputes. As a skilled public speaker with the ability to effectively apply analytical skills to develop well reasoned and detailed reports, both oral and written, for presentation to, or negotiation with, a variety of audiences, she handles the representation of affected parties in negotiations and hearings in front of all levels of governmental bodies. When necessary, Ms. Durkin also handles all appeals from the government or administrative body decisions, including filing Petitions for Certioriari and Writs of Mandamus.
In the event her clients, or other attorneys who are not comfortable with filing and arguing appeals on behalf of their own clients, are in need of filing appeals of court or administrative decisions, Ms. Durkin handles such appeals in all Florida appellate courts, preparing the appellate briefs and arguing her client's position at oral argument. She has handled a variety of appellate cases in the 11th Circuit Court of Appeal and United States 5th Circuit Court of Appeal and has also argued cases before the State of Florida 2nd and 5th District Courts of Appeal.
Fluent in German, both written and spoken, and a frequent overseas traveler, Ms. Durkin is able to provide representation and support for clients with overseas contacts or business interests.
